Un-Family Court: I'm a dad with two boys and an ex-wife who worked nights and weekends. I say that because i exclusively cared for our infants for the first 2-3 years of their lives.. After my ex confessed to an affair with a co-worker (also married) my ex and I decided on divorcing.

Our facilitator at the MSA said this would be the only opportunity to establish a mutual agreement and that my declaration of assets had to match my ex's. Only one problem: the facilitator gave me false information. The facilitator had me fill out the declaration on the spot. My ex got the community assets while I got the community debts. I honestly believed there would be a final disclosure of assets not just the primary.

We decided on Joint 50/50 legal and custodial because the boys were 2yo and 3yo. One year after the divorce judgement, my ex OUT OF NOWHERE accused me of engaging in DV and Child Molesting. She got a TRO - which immediately took away my kids for two months while CPS investigated. The investigation (single interview) came back as "unfounded". The TRO affected my work because the boys were at a daycare where I work. CPS conducted no interviews with the boys' daycare providers nor a physician.

The judge threatened my ex indicating that if the allegations were later proven false she'd be held responsible. However, as evidence of the judges lack of sincerity, he never ordered an investigation nor did CPS. I was told by CPS that they don't have the resources to investigate false allegations.

The attorney I hired assured me we'd get back all of my expenses including his firm's fees, but he was not truthful -- he never submitted the request.

My suggestions for any father going through a divorce. Document, document, document your spouse's work schedule, financial reports, physician reports, any common assets vs personal assets. If you can, get a post nuptial agreement. Family court is there to strip you of your rights and will not protect your rights.
